One of the pieces of legislation that has been rolled into the government’s omnibus crime bill was previously known as the Justice for Victims of Terrorism Act and is described by the government thusly: [It] would allow victims of terrorism to sue perpetrators and supporters of terrorism, including listed foreign states, for loss or damage that occurred as a result of an act of terrorism committed anywhere in the world; Here’s my question: does that mean that someone of Pakistani origin who has family that has been killed by CIA drone attacks would be able to sue the United States? If not, why not? (Okay, that’s two questions.) There has been no declaration of war against Pakistan and those attacks, which are aimed at people suspected of terrorist activity but never subjected to any kind of due process, have no legal basis that I can think of. And you can be certain that some of the people killed in those attacks were just in the wrong place at the wrong time.
