An unsigned editorial in yesterday’s Toronto Star argues that it’s not Canada’s place or Canada’s problem to take someone like George W. Bush into custody and put him on trial for his involvement in torture. But it is up to the U.S. and its credible legal system, not the wider world, to deal with this matter. That’s codified in the Rome Statute that set up the International Criminal Court, and in the Convention against Torture. If the U.S. is unwilling or unable, complainants have recourse to the ICC itself, even though the U.S. is not a party to the statute. How credible is the American legal system when it refuses to deal with people like Bush or Cheney who have now openly admitted that they ordered the torture of detainees?
